Petitioner seeks bail in a case registered under section 302 and other minor sections of the Indian Penal Code. There is accusation against the petitioner that he along with five others accused mercilessly assaulted the deceased but post mortem report which is annexed as annexure 2 to this petition does not support the prosecution case as no external injury was found on the person of the deceased and the doctor could not give the definite opinion regarding cause of death.

Moreover, having more or less similar allegation two coaccused have already been granted privilege of bail. Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate,
