The petitioner wants to renew his prayer of bail, which was earlier rejected on four times, on the ground that trial has not been concluded within time given and from the report of the learned Trial Judge, it reveals that in near future, the trial is not likely to be concluded, to which the learned A.P.P. opposes. In the facts and circumstances stated above, considering that the petitioner is suffering in custody since 19.07.2013 and in near future the trial is not likely to be concluded and as such, the petitioner is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of the learned
Patna High Court Cr.Misc. No.30342 of 2016 (3) dt.24-08-2016 2/2 Additional Sessions Judge-III, Patna, in connection with Sessions Trial No. 311 of 2014, arising out of Agamkuan P.S. Case No. 209 of 2013, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail and petitioner shall not make any attempt to influence the prosecution witnesses and shall co-operate during trial.
