JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 11-07-2018 From the report of the Superintendent of Police, Jamui communicated vide Letter No.144 dated 03.07.2018, it is evident that fourteen (14) witnesses have already been examined. From the report of the learned District & Sessions Judge, Jamui communicated vide Letter No.16 dated 18.04.2018, it is evident that fifteen witnesses have been named in chargesheet including the then Superintendent of Police, Jamui, who now is posted at West Champaran at Bettiah.

Accordingly, prosecution to take proper step for production of the Superintendent of Police, if so desires to examine him on next date by having his physical presence positively, failing which the learned lower Court will be at liberty to pass appropriate order.

Patna High Court Cr.Misc. No.35540 of 2017 (09) dt.11-07-2018 Office to communicate upon the Superintendent of Police, Jamui, the District Magistrate, Jamui and in the aforesaid background, as majority of the witnesses have already been examined on account thereof, now remains no utility to keep this petition pending and is accordingly, dismissed.
