JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 13-12-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner apprehends his arrest in connection with G.O.Case No. 347 of 2015, registered for the offence punishable under Section 47(A) & (F) of the Bihar Excise Act. Allegedly, 4o liters illegal liquor and 600 Kgs. Jawa Mahua were recovered from the vacant land of co-accused Rajo Yadav.

Submission is of false implication and that there is no evidence to show that the petitioner was preparing Jawa Mahua and country made liquor from Mahua. On mere suspicion the name of the petitioner has figured in the case. Co accused has been allowed pre-arrest bail vide Cr. Misc. No. 39779 of 2016

Patna High Court Cr.Misc. No.30672 of 2016 (3) dt.13-12-2016 2/2 and, as such, the petitioner also deserves sympathetic consideration.

The learned A.P.P. opposes the prayer of bail. In the facts and circumstances as stated above, in the event of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri N.K. Singh, Judicial Magistrate 1st Class, Nawada, in connection with G.O. Case No. 347 of 2015, subject to the conditions as laid down in section 438(2) of the Cr.P.C.
