JUSTICE SUDHIR SINGH ORAL ORDER 08-09-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Section 392 of the I.P.C.
The prosecution story, in brief, is that on the alleged date and time of occurrence the informant proceeded to Suryapur Hat for purchasing cattle with Rs.65,000/- in his possession. After finishing the work in the market he along with one Md. Enul and Bhuwneshwar Mukhiya proceeded back to their village and when they were coming back to their house, four unknown miscreants snatched Rs.45,000/-, Rs.1500/- and fishing net from the possession of the informant, Md. Enul and Bhuwneshwar Mukhiya. The miscreants also snatched the mobile set of the informant.

No.30429 of 2016 (3) dt.08-09-2016 2/2 It has been submitted on behalf of the petitioner that the petitioner is in custody since 4.5.2016 and the charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. The petitioner has not been put on Test Identification Parade to ascertain his involvement in the present case.
On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional C.J.M. II, Supaul in connection with Chhatapur P.S. case No.272 of 2015.
