The petitioner seeks bail Nardiganj P.S. Case No. 80 of 2013, registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code.

The petitioner is alleged to have assaulted the deceased with spade on his head causing death of the deceased. Considering the facts aforesaid, I am not inclined to enlarge the petitioner above named on bail. Accordingly, the same is rejected. Since the petitioner is in jail for about a year, the trial court is directed to expedite the trial and conclude the same within nine months holding the trial on day-to-day basis.
