JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-07-2016 Petitioner being second wife of the husband of the informant is apprehending her arrest in a case registered for the offences punishable under Sections 341, 323, 494, 498a, 34 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act.
The basic accusation is of torture for nonfulfilment of dowry demand and performing second marriage. It is submitted by learned counsel for the petitioner that petitioner was not aware about first marriage of her husband. The accusation under Sections 494 and 498A I.P.C is against the husband of the petitioner. Considering the thrust of accusation against the husband of the petitioner and petitioner being lady, let the petitioner, above named, in the event of her arrest or surrender before the Court below within a period of 12 weeks from today,
Patna High Court Cr.Misc. No.30154 of 2016 (2) dt.22-07-2016 2/2 be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Jhanjharpur in connection with Andhramath P.S. Case No. 30 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
