For the Petitioner/s : Mr Ranjeet Kumar Singh, Advocate For the Opposite Party/s : Mr Rajeev Nayan, APP ====================================================== CORAM: HON'BLE MR JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 04-10-2016 The petitioner apprehends arrest in Barari (Semapur) Police Station Case No 136 of 2016 instituted under Section 307 and other sections of Indian Penal Code (IPC). Learned counsel draws attention of this Court to the order dated 20.06.2016 passed by the learned Sessions Judge wherein it has been noted that the only allegation against the petitioner is that he allegedly gave a sickle blow to the informant causing injury. This, by no means, could be an offence under Section 307, IPC. He further states that there is a case and counter case and this is a dispute between two neighbours over construction.

Be that as it may, in the event of his arrest or surrender within five weeks from today, the petitioner

No.31064 of 2016 (3) dt.04-10-2016 2/2 abovenamed shall be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate V, Katihar in Barari (Semapur) PS Case No 136 of 2016 subject to all conditions as laid down in Section 438 (2) of Criminal Procedure Code.
