The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 379, 120B of the Indian Penal Code, Sections 4(1), 21(1) of The Mines and Minerals (Development and Regulation) Act, Rule 40(1) of Bihar Minor Mineral Concession Rules and Sections
Patna High Court Cr.Misc. No.36966 of 2015 (2) dt.11-09-2015 2/3 33, 41, 42 of Indian Forest Act.
The prosecution case is that the informant being a Police Sub-Inspector raided the area where the closed crushers were being run for illegal mining. The said raid was laid on the direction of D.M. and S.P., Rohtas. The names of the petitioner and others were suggested by local people as the persons who made the closed crusher units operational. It is submitted by learned counsel for the petitioner that neither any recovery has been made nor there is anything on the record to suggest that the petitioner is the owner of any crusher unit and the entire accusation has been levelled on hearsay basis. Considering the nature of accusation similarly situated Sadhu Yadav has been granted anticipatory bail vide Cr. Misc. No. 9953 of 2015. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-divisional
