Heard the learned counsel for the petitioner. The learned counsel for the petitioner has submitted that Title Suit No. 331 of 2012 is pending in the vacant court. As such, no progress in the trial is going on. In view of aforesaid submission, the learned District Judge, Madhepura is directed to transfer the title suit in any other court of competent jurisdiction, if the court is still vacant. With these observations, this civil miscellaneous petition is disposed of Office shall ensure that all the defects are removed by the petitioner within the stipulated time provided hereinabove, failing which the matter shall be brought to the notice of this Court.
