According to prosecution case itself, the alleged recovery was made by a private person but in spite of that, learned VIIIth Additional Sessions Judge, East Champaran, Motihari rejected the prayer for bail of the petitioner. The petitioner does not have any criminal antecedent, which is evident from perusal of paragraph-3 of the bail petition.

Accordingly, the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Pipra P.S. Case No. 100 of 2015 to the

Patna High Court Cr.Misc. No.36309 of 2015 (2) dt.31-08-2015 2/2 satisfaction of Chief Judicial Magistrate, East Champaran at Motihari.
