Petitioners seek bail in a case registered under Section 302 and other minor Sections of the Indian Penal Code and Section 27 of the Arms Act.
According to the prosecution case itself, it was coaccused Bipin Kumar who opened fire on the deceased and so far as petitioners are concerned, it is only stated that they along with other accused were present on the roof from where the firing was made.
The impugned of learned Sessions Judge goes to show that only one fire arm injury was found on the person of the deceased.
Patna High Court Cr.Misc. No.30031 of 2016 (2) dt.29-07-2016 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let petitioners above named are directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of C.J.M., Nawada in connection with Akbarpur P.S. Case No.77 of 2016.
