JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-01-2020 Petitioner seeks bail in connection with Basopatti P.S. Case No. 118 of 2019 registered for the offences punishable under Sections 326, 307/34 of the Indian Penal Code and Section 27 of the Arms Act.
Prosecution case is of firing by one Dev Narayan Yadav @ Jai on the informant and there is also allegation of firing against the petitioner and one more co-accused person. Submission of learned counsel for the petitioner is that FIR itself shows that firing was made by the petitioner and others and he is aged 70 years as such allegation of firing is false and concocted, which will appear from the fact that there is allegation of firing against three persons but only one injury was found on the person of injured, though the same is grievous in nature and petitioner is in custody for seven months.

In view of above facts and circumstances, let petitioner be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-V, Madhubani, in connection with Basopatti P.S. Case No. 118 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
