2. The petitioners have preferred this application for grant of regular bail in connection with Baligaon P.S. Case No. 107 of 2025 registered for the offences punishable under Sections 117(2), 115(2), 118(1), 109, 352, 351(2), 76, 126(2) read with 3(5) of the BNS.
3. As per the prosecution story, the informant has alleged that on 22.06.2025, all the accused persons named in the F.I.R. along with 3-4 unknown persons were dumping soil on her land. When she tried to stop them, Raju Singh attacked on her by means of spade (kudaal), subsequently she got injured,
Patna High Court CR. MISC. No.62584 of 2025(2) dt.09-09-2025 2/3 became unconscious and fell on the ground. After that everyone started kicking and abusing her and threatened to vacate the land or else they would kill her.
4. Learned counsel for the petitioners submits that the petitioners are innocent person and they have falsely been implicated in this case only due to village politics. Even as per version of the informant made in F.I.R. itself petitioners had not played any role in the occurrence. During the course of investigation, I.O. has recorded statement of only two witnesses. Both of them had not whispered even a single word against both the petitioners. Both the witnesses have very specifically stated that Raju Singh had blown kudal upon the informant. Both the petitioners are rotting behind the bar since 23.06.2025. Learned counsel further submits that that the allegations leveled against both petitioners are general and omnibus in nature, with no specific overt act attributed to either of them. From perusal of F.I.R., it transpires that there is admitted land dispute between both the parties. Yesterday, the main assailant namely, Rajeshwar Singh, has been granted bail by a Co-ordinate Bench of this Court in Cr. Misc. No. 61825 of 2025.
5. Learned A.P.P. appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioners.

Keeping in view the aforesaid facts, considering the period under custody and there being no direct allegation against the petitioners, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Baligaon P.S.
