Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioner seeks bail in connection with Case No. 362 C 2 of 2021 registered under Section 30(a) of the Bihar Excise and Prohibition Act.
Learned counsel for the petitioner submits that the petitioner is in custody since 31.10.2021, is a person with clean antecedent, charge-sheet has been submitted and allegation is of recovery of 171 litres of illicit liquor from a Bolero vehicle and five persons including the petitioner were arrested.
Patna High Court CR. MISC. No.528 of 2022(2) dt.02-03-2022 2/2 Learned counsel for the petitioner submits that the petitioner had taken lift and as such would not know what was kept in the Bolero vehicle.
Learned APP opposes the bail application.
Considering the fact that the petitioner is in custody, charge-sheet has been submitted and is a person with clean antecedent, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.2,000/- (Rupees two thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-II, Jamui in connection with Case No. 362 C 2 of 2021.
