1. Heard learned counsel for the petitioner and learned APP for the State.
2. The petitioner seeks bail in a case registered for the offences punishable under Sections 341, 323, 324, 325, 307, 354, 379, 504, 506 and 34 of the Indian Penal Code and later on, Section 302 IPC was also added.
3. The learned counsel for the petitioner submits that the petitioner has antecedent of one case and is in custody since 08.06.2024 and on account of dispute relating to land, the alleged occurrence is said to have taken place. It is also submitted that allegation against this petitioner is of assaulting Sanjaniya Devi by lathi causing fracture of hand. It is next submitted that both sides assaulted each other. It is also submitted that petitioner is not a criminal and the injury suffered
Patna High Court CR. MISC. No.64698 of 2024(3) dt.13-12-2024 2/2 by Sanjaniya Devi is not on vital part of body.
4. Learned A.P.P. opposes the bail application.
5. Considering the submissions made by the learned counsel appearing on behalf of the petitioner, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Tisiauta P. S. Case No.59 of 2024.
6. The application stands allowed.
