JUSTICE HEMANT GUPTA ORAL ORDER 06-10-2016 The present is an application for grant of anticipatory bail under Section 438 of the Code of Criminal Procedure to the petitioners in respect of Karagahar P.S. Case No. 285 of 2015 dated 15.10.2015 registered for the offences punishable under Sections 341, 323, 504, 506, 143, 145, 147, 149, 152, 153, 186, 188, 353 and 307 of the Indian Penal Code. In the F.I.R., the allegation against the petitioners is that the BSP candidate Karaghar Vidhan Sabha, Shamim Ahmad and BSP leaders Moti Ram, Isha Mian, Firoz Mian, Sarfu Mian, Nirmal Ram along with 50-60 unknown persons entered into the campus of police station and made murderous attack on police
Patna High Court Cr.Misc. No.30420 of 2016 (2) dt.06-10-2016 2/2 personnel by using abusive language. It is also alleged that the dead body of Pappu Kumar was taken away and kept on the road causing traffic hindrance.
Since the allegation against the petitioners is of entering into the campus of police station and making murderous attack on police personnel, therefore, I do not find any case is made out for grant of anticipatory bail. Accordingly, the present application is dismissed.
