JUSTICE SANJAY PRIYA ORAL ORDER 21-03-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Jalalpur P.S. Case No. 100 of 2016 instituted for the offence under sections 147, 341, 323, 324, 379, 307, 504 and 506 of the Indian Penal Code.
There is allegation against this petitioner that he assaulted the brother of informant Ram Ratan Singh on his head, on account of which, he fell down on the ground. The learned A.P.P. has pointed out injuries of the injured as mentioned in para 25 of the case diary wherein two lacerated wound have been found over the scalp of the injured caused by hard blunt object.
In this manner, there is specific allegation of assault
Patna High Court Cr.Misc. No.6160 of 2017 (3) dt.21-03-2017 2/2 against this petitioner and also from the injuries, it appears that there is repetition of blow on the head of brother of the informant. In such circumstances, this court is not inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer for anticipatory bail of the petitioner is rejected. The petitioner is directed to surrender before the court below and pray for regular bail.
