The petitioner is apprehending his arrest in connection with Special Case No.149/2019 CIS 149 of 2019 registered for offences punishable under Section 30(A) of the Bihar Prohibition and Excise Act..

Allegation against the petitioner is about recovery of 72 ltrs of liquor from the Alto vehicle of the petitioner. Submission of the learned counsel for the petitioner is that he has been named by the co-accused and he has falsely been implicated in this case, having no criminal antecedent and vehicle also does not belong to the petitioner. Heard learned A.P.P. also.

Having heard both sides and in view of the fact that he is

No.62725 of 2019(2) dt.15-10-2019 2/2 named in the FIR, as the person who succeeded in fleeing away from the place of occurrence, as such I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below and make prayer for regular bail, which shall be considered on the basis of materials available in the case diary. With the aforesaid direction, this application is dismissed.
