====================================================== CORAM: HONOURABLE MR. JUSTICE V.N. SINHA ORAL ORDER 07-10-2015 Heard learned counsel for the petitioner and the State. Petitioner is apprehending his arrest in connection with a case registered for the offence under Section 272 of the Indian Penal Code and Section 47(A) of the Excise Act in which police submitted final form so far this petitioner is concerned, but differing therewith he has also been summoned and his prayer for bail has been rejected by the court below.

It is submitted on behalf of the petitioner that the subject matter of the prosecution case is recovery of 31 liters of country made liquor and his antecedent being clean deserves grant of bail in the event of arrest.

Let petitioner above named surrender in the court

Patna High Court Cr.Misc. No.40331 of 2015 (2) dt.07-10-2015 2/2 below within four weeks from the date of receipt/ production of a copy of this order and thereafter be released on bail on furnishing bail bond of Rs. 5,000/- (Rs. Five thousand only) with two sureties of the like amount each to the satisfaction of Sri M.K. Sahi, Judicial Magistrate 1st Class, Sadar, East Champaran at Motihari in connection with Muffasil P.S.
