Mr. Ajay Kumar Sinha ====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 08-08-2022 Heard learned counsel for the petitioner, learned APP for the State as well as learned counsel appearing on behalf of the complainant.

The petitioner apprehends his arrest in connection with Complaint Case No.3680(C) of 2018, registered for the offences punishable under Sections 406 and 420 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. It is submitted that the petitioner is the only employee of the said company. It is also submitted that from

No.1803 of 2022(3) dt.08-08-2022 2/2 perusal of the C & F agreement itself, it is clear that petitioner is not signtory of it either as authorized representative of the company or a witness. Learned counsel for the petitioner submits that the complainant has also filed complaint case against the petitioner in the State of Jharkhand being Complaint Case No.2174 of 2018 in which the petitioner has already been enlarged on anticipatory bail by a Bench of Jharkhand High Court.

Taking into consideration the fact that petitioner is only the employee of the company, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Judge-cum-ACJM-XIII, Patna in connection with Complaint Case No.3680(C) of 2018, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
