Mr. Rajendra Singh, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 08-10-2025 Heard Ms. Dimpal Kumari, learned counsel appearing on behalf of the petitioner and Mr. Rajendra Singh, learned APP appearing on behalf of the State.

2. The petitioner apprehends his arrest in connection with Complaint Case No. 583(C) of 2023 registered under Section 498 (A) of the Indian Penal Code and Sections 3 and 4 of the DP Act.

3. Allegation against the petitioner is to have assaulted the opposite party no.2 for non-fulfillment of demand of dowry.

4. At the outset, learned counsel appearing on behalf of the petitioner submitted that the petitioner is ready to keep his wife along with him with full dignity and he will also support

5. Learned APP submitted that opportunity shall be given to the parties to reconcile their dispute amicably.

Having considered the rival submissions made on behalf of the parties, as well as, considering the desire of the petitioner that to resolve his matrimonial dispute and to give his love and affection to his child, he is willing to live along with his wife, I am of the opinion that the petitioner has, prima facie, made out a case to be released on anticipatory bail.

The learned District Court is directed to release the petitioner on anticipatory bail, in the event of his arrest or surrender before the learned District Court within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each, to the satisfaction of learned District Court where the case is pending in connection with Complaint Case No. 583(C) of 2023, subject to the condition as laid down under Section 482 of BNSS.

8. However, it is open to the parties to compromise and learned District Court should also strive to settle the dispute amicably by taking necessary action to refer the matter before the learned Mediator of the District Mediation Center.

9. Accordingly, the present application stands disposed of.
