The petitioner apprehends her arrest in Athmalgola P.S. Case No.233 of 2016 for the offences punishable under Sections 363 and 366(A) of the Indian Penal Code.

It has been submitted on behalf of the petitioner that petitioner is an unmarried girl and she has falsely been made accused in the case. He has no concern with the victim girl. The victim girl has love affairs with one Karan Kumar and only allegation against the petitioner is that she assisted the said Karan Kumar in the alleged occurrence and except that there is nothing against her.

Heard learned A.P.P. also, who opposes the prayer for bail.

Patna High Court Cr.Misc. No.7184 of 2017 (2) dt.20-02-2017 Having heard both sides. In view of the fact that there is no allegation other than the petitioner also assisted in that occurrence and she is lady, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Barh, Patna in connection with Athmalgola P.S. Case No.233 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and subject to the further condition that the petitioner shall cooperate in the investigation and make herself available as and when required by the police, and if during the investigation any serious material comes against her after submission of charge-sheet, the prosecution is at liberty to move for cancellation of her bail bonds.
