The petitioner in the present case is seeking regular bail in connection with Special (POCSO) Case No.16 of 2019, arising out of Jakkanpur P.S. Case No.59 of 2019, registered for the offence punishable under Sections 354, 376 and 511 of the Indian Penal Code and Sections 4, 7, 8 and 12 of the POCSO Act. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Learned counsel submits that there is no specific allegation against the petitioner.

Learned APP has opposed the prayer for bail.

Considering the facts and circumstances of the case and the seriousness of the allegations wherein the petitioner is said to

No.62552 of 2019(3) dt.03-12-2019 2/2 have taken attempt to rape the minor daughter of the informant aged about 7 years only and the name of the petitioner has been taken by the victim girl in her statement under Section 164 Cr.P.C., this Court is not inclined to grant regular bail to the petitioner at this stage. This application is dismissed.
