The petitioner is apprehending his arrest in connection with Mufassil P.S.Case no.306 of 2018 registered for offences punishable under Sections 504, 506, 387, 379, 427/34 of the Indian Penal Code.

Allegation against the petitioner is that he has damaged the boundary wall,eight Seesam true were cut down and petitioner has demanded Rs.2 lac from the informant.

Submission of the learned counsel for the petitioner is that there is delay of eight days in lodging the FIR and no explanation has been given and the petitioner is neighbour. He has falsely been implicated in this case, having no criminal antecedent.

Heard learned A.P.P. also.

No.78782 of 2018(2) dt.11-01-2019 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below within a period of six weeks from the date of order and make prayer for regular bail, which will be considered by the learned court below on the basis of materials available on the record and to be disposed of if possible on the same day.

With the aforesaid observation, this application is dismissed.
