04-10-2016 Heard Ms. Ranjana Bharti, learned counsel for the petitioner and learned counsel for the State. The petitioner apprehends his arrest in relation to Bidupur P.S. Case No. 27/2016 registered under Sections 363 and 366A of the Indian Penal Code. The informant, Upendra Singh, lodged the aforesaid case on 07.02.2016, inter alia, alleging that his niece has running off with the petitioner on 24.01.2016 carries some money. This niece, Khusboo Kumari, is traceless. Subsequently, on 27.02.2016, the said niece certainly turned up in the S.P. Office, and her statement under Section 164 Cr.P.C. was recorded, wherein she alleges that, on 24.01.2016, she has walked out of the house to marry Vikash Kumar, the petitioner. He had
asked for money and, therefore, she had carried Rs. 1 Lac, which her mother had kept to buy a Car. From Hazipur, they went to Kolkata, where they stayed in the house of petitioner's aunt and from there they went to Haryana, where they stayed with the sister of the petitioner. She did not know where she had gone because her eyes and mouth was to be tied. She was then brought to Hazipur on 24.02.2016, petitioner was also with her. From the Station police brought her to the office of S.P. and left her. She also states that she was only for two days at the house of the aunt of petitioner and for ten minutes at the house of petitioner's sister in Haryana. Where she was for the rest of the month, she does not say. Why been she came to Hazipur and reached Police Station on 24.02.2016, her statement was recorded. It was only recorded three days later on 27.02.2016, she has not explained.
In that view of the matter, considering the aforesaid, in the event of his arrest/surrender before the court below within four weeks, let the above named petitioner, namely, Vikash Kumar @ Sunjan Kumar, be enlarged on bail on furnishing bail bonds of Rs. 10,000/-
(ten thousand only) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hazipur, in connection with Bidupur P.S. Case No. 27/2016, subject to condition laid down under Section 438 (2) of the Code of Criminal Procedure. (Navaniti Prasad Singh, J,) Rajeev/- U T
