JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-11-2019 Petitioner seeks bail in anticipation of his arrest in connection with Mahila P.S. Case No. 49 of 2019, G.R. No. 4214 of 2019 registered for the offences punishable under Sections 498A, 420, 506, 494, 34 of the Indian Penal Code. As per F.I.R. petitioner has solemnized marriage with informant and later on she came to know that petitioner would marry with some other lady. On that information she went to the petitioner place and petitioner informed that he is solemnizing marry on the pressure of his family member.

Submission of the learned counsel for the petitioner is that there is no chit of paper regarding marriage of informant and even photograph of the marriage to show solemnization of marriage between the informant and petitioner. He has been falsely implicated in this case.

Having heard both sides, considering the above submission, this application allowed. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Five Thousand) with two sureties of the like amount to the satisfaction of learned J.M. 1st class Patna in connection with Mahila P.S. Case No.-49 of 2019, G.R. No. 4214 of 2019 subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the Court concerned with further condition that he will cooperate in the investigation and appear before the police as and when require.
