JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 03-03-2015 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Tr. No. 2130 of 2014 arising out of Complaint Case No. 1477 of 2012 registered under Section 406 of the Indian Penal Code. The accusation is that petitioner being the then Mukhiya along with co-accused, the then Panchayat Secretary, credited Rs. 24,000/- from the account of the complainant. Learned counsel for the petitioner submits that petitioner, who was the Mukhiya, has falsely been implicated in this case at the instance of the present Mukhiya. It is further submitted that petitioner is in custody since 10.09.2014.

Patna High Court Cr.Misc. No.48740 of 2014 (2) dt.03-03-2015 Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate Ist Class, Bettiah, West Champaran, in connection with Tr. No. 2130 of 2014 arising out of Complaint Case No. 1477 of 2012.
