JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offence punishable under Section 307/34 of the Indian Penal Code and Section 27A of the Arms Act.

Petitioner is named in the First Information Report but it was co-accused Sumant Kumar, who is said to have opened fire, causing firearm injury to the informant, who appears to have sustained simple injury, said to be caused by firearm. The petitioner is in jail custody since 12.05.2016 and except the present case as well as one Naubatpur P.S. Case No. 30 of 2016, the petitioner does not have any criminal antecedent. Considering the aforesaid facts and circumstances as

Patna High Court Cr.Misc. No.30947 of 2016 (2) dt.09-08-2016 2/2 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Masaurhi, Patna in connection with Masaurhi P.S. Case No. 290 of 2015.
