JUSTICE AJAY KUMAR TRIPATHI ORAL JUDGMENT Date: 05-11-2015 The reason for non- appointment of the petitioner on the post of a Constable is that he has lesser marks than the last recommended candidate in his category. The last person appointed in the category of the petitioner has 168 marks whereas the petitioner has secured only 165 marks. This position is evident from paragraph 15 of the counter affidavit.

This is the only reason for non-appointment of the petitioner despite otherwise being successful in the selection process. In view of the above, no direction can be issued in
