JUSTICE DINESH KUMAR SINGH ORAL ORDER 16-08-2016 Heard learned counsels for the petitioner and the State. The petitioner being husband of the informant is languishing in custody since 6.6.2016 in a case registered for the offences punishable under Sections 498A,379,323,324,325 and 341/34 of the Indian Penal Code.

The prosecution case is that the informant Soni Kumari was married with the petitioner on 1.7.2007 but subsequently torture was inflicted for non-fulfillment of dowry demands. It is alleged that the petitioner and his cousin Chandramohan assaulted the informant and maternal brother of the informant namely Toni causing fracture injury.

It is submitted by the learned counsel for the petitioner

Patna High Court Cr.Misc. No.32119 of 2016 (3) dt.16-08-2016 2/2 that the accusation is omnibus and general and simple injuries have been found.

Learned APP, after going through the case diary, does not suggest that either the informant or her maternal brother has received any grievous injury.

Considering the nature of accusation, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. Ist Class, Patna in connection with Ram Krishna Nagar P.S. Case No. 216 of 2013. (Dinesh Kumar Singh, J) Anil/- U T
