The petitioner seeks bail in a case registered for the offence under Sections 379, 411, 413 of the Indian Penal Code. It is submitted on behalf of petitioner that petitioner has been made accused in this case on the basis of confessional statement of co-accused Manish Kumar, who was apprehended on spot while committing theft. It is further submitted that the seized motorcycle is not stolen, rather it belongs to petitioner himself, as he had purchased it from one Shivnandan Kumar on payment of Rs. 15,000/-. Petitioner is in custody since 31.08.2021.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named
