JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-01-2019 This is an application for grant of anticipatory bail in connection with Mohania P.S. Case No. 396 of 2018, disclosing offences under Sections 448, 341, 379, 380, 323, 354(A)(2), 504, 34 of the Indian Penal Code.

Allegation as per F.I.R. is that earlier the petitioners had pushed the father-in-law of the informant, due to which he received fracture injury and when the informant was going to lodge a criminal case against the petitioners, then after giving assurance to pay the compensation towards the treatment of her father-in-law, she has not lodged a case. Thereafter, when the complainant demanded Rs.10,000/-, then the petitioners have also assaulted the informant and snatched aways golden chain and ornaments.

No.78652 of 2018(2) dt.10-01-2019 2/2 Submission of learned counsel for the petitioners is that on bare perusal of the complaint petition it appears that the dispute is with respect to demand of rupees ten thousand, but to make the case serious, allegation under Section 354(A) of Indian Penal Code has also been added. Further, petitioners have no criminal antecedents.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabhua, in connection with Mohania P.S. Case No. 396 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
