2. Despite issuance of notice, no-one appears on behalf of the opposite party no.2.

3. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 341, 342, 498(A), 379, 494, 504, 506 and 324 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.

4. The case is filed under Section 498A of the Indian Penal Code and the petitioner is the husband. The complaint has been filed making allegation of demand of dowry and torture.

5. Learned counsel for the petitioner submits that the

No.67927 of 2023(6) dt.18-06-2025 2/2 allegations made in the complaint are not correct and as a matter of fact the petitioner is always ready to keep his wife with full dignity and honour and it is the opposite party no.2 who is not aggreable on residing with the petitioner. It is informed that the opposite party no.2 has also filed a maintenance case. Petitioner has no criminal antecedent.

6. Learned APP for the State opposes for prayer for bail.

In view of the aforesaid facts of the case, it is directed that the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Complaint Case No. 07C/2022 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Khagaria, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure/Section 482(2) of the B.N.S.S, 2023.
