JUSTICE SANJAY PRIYA ORAL ORDER 18-03-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Rajauli P.S. Case No. 302 of 2016 instituted for the offence under Section 30(a) of Bihar Excise Act.

It is alleged that total 62.25 foreign liquor was recovered from the car which was driven by this petitioner and one Tarkeshwar Prasad was found sitting in the car. It is submitted that petitioner is in custody since 29.11.2016.

It is mentioned in para-3 that the petitioner has no criminal antecedent.

The co-accused Tarkeshwar Prasad has been granted bail by a coordinate Bench of this court in Cr. Misc. No. 3111 of

Patna High Court Cr.Misc. No.8806 of 2017 (2) dt.18-03-2017 2/2 2017 vide order dated 01.03.2017.

Considering the aforesaid facts and circumstances, the prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada, in connection with Rajauli P.S. Case No. 302 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioner.
