The petitioner is apprehending his arrest in connection with Harnaut P.S.Case No.239/18 registered for offences punishable under Section 366A of the Indian Penal Code. Allegation against the petitioner is of kidnapping of the minor sister of the informant.
Submission of the learned counsel for the petitioner is that only on suspicion he has been made accused and the restatement of the informant clearly shows that earlier there was love affair between the petitioner and the victim girl and thereafter she came back and started residing along with the informant. Further submission is that as a matter of fact the girl fled away with one another boy and started residing at Haryana. Heard learned A.P.P. also.

No.78950 of 2018(4) dt.07-02-2019 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on provisional bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Nalanda at Biharsharif in connection with Harnaut P.S.Case No.239 of 2018, with condition that he will co-operate the police in tracing out the girl and further condition that even after investigation the charge-sheet is submitted against the petitioner he has to surrender and make prayer for regular bail, which shall be considered on the basis of materials available on the record.
