Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Muffasil P.S. Case No. 423 of 2022 lodged under Sections 379, 414/34 of the I.P.C.

As per the prosecution case, the present petitioner has been caught red-handed, while he was trying to start the motorcycle of some other person.

Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. He further submits that petitioner is in custody since 12.06.2022 having

He submits that the content of the F.I.R. is true but it is also true that the petitioner visited the market on the said date of occurrence and due to mistake, he misunderstood someone else's bike as his own bike and tried to start it by putting his key in the said bike due to which the bike owner and some other people present there caught him and handed over him to the police. He further submits that offence is lodged under those sections, which are Magisterial Triable. Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., East Champaran, Motihari in connection with Muffasil P.S. Case No. 423 of 2022, subject to the conditions as laid down under Section 437(3) of Cr.P.C. With this observation, the bail application stands allowed.
