JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 10-03-2017 Heard learned counsel for the petitioner and learned counsel representing the State.
The petitioner apprehends his arrest in connection with Kurtha P.S. Case No. 59 of 2007, registered for the offence punishable under Section 302/34 of the Indian Penal Code. The petitioner is named in the First Information Report along with others, but after investigation final form was submitted after finding the petitioner and others named accused as innocent, but the learned Court below after differing with the opinion of the I.O. took cognizance, resulting, the petitioner is apprehending his arrest.
The learned A.P.P. opposes the prayer of pre-arrest bail.
In the facts and circumstances as stated above, the
Patna High Court Cr.Misc. No.9174 of 2017 (2) dt.10-03-2017 2/2 petitioner in the event of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Deepak Kumar Yadav, learned Judicial Magistrate 1st Class, Jehanabad, in connection with Kurtha P.S. Case No. 59 of 2007, subject to the conditions as laid down in section 438(2) of the Cr.P.C.
