The petitioner seeks pre-arrest bail in connection with Kotwali P.S. Case No.407 of 2018 registered for the offence punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.

Considering the recovery of 40 bottles of Indian made foreign liquor from the motorcycle of the petitioner as also the bar created under sub-Section (2) of Section 76 of the Bihar Prohibition and Excise Act, 2016, I am not inclined to grant him pre-arrest bail. The application is rejected. In case, the petitioner surrenders and seeks bail, the same shall be considered on its own merit without being
