JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 19-04-2023 The present petition has been filed for modification of the order dated 30.03.2022 passed in Cr. Misc. No. 49180 of 2021 to the extent of extending the period of surrender.

It is submitted by learned counsel for the petitioner that Cr. Misc. No. 36405 of 2022 was filed for modification of the order dated 30.03.2022 to the extent of extending the period of surrender which was allowed vide order dated 31.08.2022 and petitioner was directed to surrender and furnish bail bonds within a period of four weeks from the date of passing the order. It is further submitted that just after filing of the modification

Patna High Court CR. MISC. No.20465 of 2023(2) dt.19-04-2023 2/2 petition, the husband of the petitioner, who was working in Pune became seriously ill, hence, she had to go to Pune to take care of her husband. Hence, she could not furnish the bail bonds on time.

Considering the fact that anticipatory bail of the petitioner was allowed on 30.03.2022 and thereafter modification application to the extent of extending the period of surrender was also allowed on 31.08.2022 but the petitioner could not comply the order of this Court and again filed modification application for modifying the order 30.03.2022 to the extent of extending the period of surrender, this Court is not inclined to modify the order 30.03.2022 passed in Cr. Misc. No. 49180 of 2021.

Accordingly, the petition stands dismissed.
