JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 11-02-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner seeks pre-arrest bail in connection with Delha P.S. Case No.264 of 2018 registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. Considering the allegation of recovery of one thousand pouches containing liquor made in Jharkhand kept in five gunny bags belongs to the petitioner as per the information received by the police as also the provision prescribed under sub-section (2) of Section 76 of the Bihar Prohibition and Excise Act, 2016, I am not inclined to grant him pre-arrest bail. The application for grant of pre-arrest bail is rejected.

In case, the petitioner surrenders and seeks bail the

Patna High Court Cr.Misc. No.80696 of 2018(2) dt.11-02-2019 2/2 same shall be considered on its own merits without being prejudiced in any manner by this order.
