The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 448, 504, 307 and 379/34 of the Indian Penal Code. It is alleged that the petitioner assaulted the informant with iron rod on the head whereas other accused persons assaulted the mother of the informant with rod and lathi and snatched gold chain and earring.

It is submitted by learned counsel for the petitioner that there is no accusation of repeating the blow. The injury has been found to be simple and there is counter version of the occurrence also.

No.40617 of 2015 (2) dt.01-10-2015 2/2 The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Maker P.S. Case No. 80 of 2014 pending in the court of learned Sub-divisional Judicial Magistrate, Saran at Chapra.

With the aforesaid observation, this application is disposed of.
