The petitioner seeks bail in a case registered for the offences punishable under Sections 461 and 379 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is in custody since 14.12.2020, charge-sheet has been submitted and is a person with clean antecedent. The informant alleges that unknown thieves committed theft in his shop and in the shop of Vinod Kumar and stole cash as detailed in the F.I.R.

Learned counsel for the petitioner submits that the petitioner is alleged to have been identified by the local people based on CCTV footage. Learned counsel for the petitioner

No.1102 of 2022(2) dt.23-05-2022 2/2 further submits that based on the disclosure made by the locals, the police arrested the petitioner and alleged that some looted cash was seized from the possession of the petitioner when the alleged seized cash belonged to the family members of the petitioner.

Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.

Considering the fact that the petitioner is in custody since 14.12.2020, charge-sheet has been submitted and is a person with clean antecedent, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Bhairoganj P.S. Case No. 726 of 2020.
