The Petitioner seeks bail in Tikapatti P.S. Case No. 130 of 2016 instituted for the offence under Section(s) 341, 323, 326, 307, 34 of the Indian Penal Code.

It has been submitted that there is specific allegation against co-accused Rameshwar Mahto of assaulting the husband of the informant with Dabia on his head. Rameshwar Mahto was tenant in the house of the informant and it is alleged that due to demand of rent of the shop by the husband of the informant, co-accused Rameshwar Mahto and this petitioner assaulted the husband of the informant.

Patna High Court Cr.Misc. No.8095 of 2017 (2) dt.07-03-2017 2/2 petitioner is that he along with co-accused Rameshwar Mahto called the husband of the informant. It is further alleged that the informant saw that this petitioner and co-accused Rameshwar Mahto had pressed her husband when she came on hearing cry of her husband.

In this manner, there is no specific overt act alleged against this petitioner.

The petitioner is in custody since 19.10.2016. In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the Petitioner, above named, be released on bail on furnishing bail bond of 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with Tikapatti P.S. Case No. 130 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioner.
