JUSTICE SUDHIR SINGH ORAL ORDER 01-10-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending her arrest in a case instituted under Section 364 of the Indian Penal Code. Prosecution case is that petitioner with the help of coaccused Nasir Miyan called the husband of the informant from the house with the help of another co-accused Tulsi Manjhi and took him away to unknown place wherefrom he (husband of the informant) is traceless till date.

It has been submitted on behalf of the petitioner that she has no criminal antecedent. There is case and counter case due to earlier dispute between the parties. The present case has been instituted at the instigation of one Babu Chand Manjhi, who is husband of the informant. Other co-accused has been granted bail vide Cr. Misc. no. 5303 of 2015.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let

Patna High Court Cr.Misc. No.39800 of 2015 (2) dt.01-10-2015 2 / 2 the above named petitioner, in the event of arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya, in connection with Wajirganj P.S. Case no. 114 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Sudhir Singh, J) sudip/- U T
