JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-10-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 419, 420 of the Indian Penal Code and 138 of the N.I. Act.

It is alleged that the petitioner purchased different electronic goods from the shop of the informant and issued a cheque of rupees two lakhs but the cheque was not honoured since the signature on the cheque did not tally with the signature of the account holder.

It is submitted by learned counsel for the petitioner that the petitioner's cheque got lost and for that due information was given to the concerned bank on 15.04.2015 as well as on 06.05.2015 Informatory Petition No.116 of 2015 was filed and, thereafter the present case was registered on 08.05.2015 for non-

Patna High Court Cr.Misc. No.39919 of 2015 (2) dt.07-10-2015 2/2 encashment of the cheque. Moreover, A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the informatory petition being filed by the petitioner with regard to lost cheque at earlier point of time, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Jamui in connection with Jamui P.S. Case No.128 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
