The petitioners apprehend their arrest in connection with Kishanpur P.S. Case No. 258 of 2016 registered under Sections 147, 148, 149, 341, 323, 324, 325, 307, 379, 447 and 504 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioners submits that there is general and omnibus allegation against the petitioners. The occurrence took place due to land dispute between the parties.

Patna High Court Cr.Misc. No.8053 of 2017 (3) dt.18-03-2017 2/2 Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioners with submission that the informant sustained several injuries by means of lathi and danda, but petitioner nos. 1 and 2 assaulted the informant through khanti and ballam on the vital part of the body with intention to kill him. Having considered the facts and circumstances of the case, prayer of the petitioner nos. 1 and 2 for bail is hereby rejected.

As far as prayer of the rest petitioners is concerned, they (petitioners no. 3 to 8) are directed to be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the C.J.M., Supaul in connection with Kishanpur P.S. Case No. 258 of 2016, subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Arvind Srivastava, J) Shailendra/- U T
