Case No. 97 of 2013 registered under Sections395 & 397 of the Indian Penal Code and accordingly, both the above-said petitions are being disposed off by this common order. Heard learned counsel for the petitioners as well as
Patna High Court Cr.Misc. No.48341 of 2014 (2) dt.16-04-2015 leaned Additional Public Prosecutor for the State. Petitioners are not named in the first information report and it appears that the name of the petitioners came in this case in confessional statement of co-accused. Learned counsel, appearing for petitioners points out that except criminal antecedent and confessional statement, there is nothing against these petitioners and moreover, co-accused who was identified by the witness in Test Identification Parade, has already been granted privilege of by a coordinate bench of this court vide order dated 24-06-2014 passed in Cr. Misc. No. 8804 of 2014.
Accordingly, the petitioners named above, are directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Kadwa (Balia Belon) P.S. Case No. 97 of 2013 to the satisfaction of learned Chief Judicial Magistrate, Katihar.
