Learned counsel for the petitioner submits that by order dated 01.07.2022, petitioner was granted anticipatory bail but prior to that order, petitioner was arrested. Learned counsel further submits that he was not instructed on that issue, as such, when the matter was taken up this fact could not be brought to the notice of the Court, as such, learned counsel prays that the order dated 01.07.2022 is recalled.

In view of the submissions made by the learned counsel for the petitioner, the order dated 01.07.2022 is hereby recalled and the case is dismissed as withdrawn.

Accordingly, this anticipatory bail application is dismissed as withdrawn in connection with Barbigha (Keoti O.P.) P.S. Case No. 398 of 2021 pending in the Court of learned Additional Sessions Judge-II, Sheikhpura/successor Court.
