The petitioner seeks bail in a case registered under Section 47 (c) of the Excise Act and Section 20 of the NDPS Act. It is submitted on behalf of the petitioner that allegedly 65 grams of Ganja was recovered from Katra but not from the personal possession of the petitioner. Petitioner is stated to be in custody since 16.10.2014. It is also stated that petitioner is having clean antecedent.
Having regard to the facts and the circumstances of the case, the petitioner, Sunil Kumar Yadav is directed to be released on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each
Patna High Court Cr.Misc. No.48666 of 2014 (2) dt.03-03-2015 2 / 2 to the satisfaction of the District and Sessions Judge, Saharsa in connection with Special Case No.14/2014 arising out of Bakhtiyarpur (Balwahat O.P.) with a condition that one of the bailors of the petitioner must be the close relative of his family member, who will file affidavit before the court below giving full genealogy showing his or her relationship with the petitioner. Further, if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
